BLD WARRANTY INFORMATION
BLD Limited Warranty & Technical Support Agreement
This BLD Limited Warranty & Technical Support Agreement (this “Warranty”) gives the original purchaser (“you”) of the System (as defined below) express limited warranty rights from NZXT, Inc. (“NZXT”) during the Warranty Period (as defined below).
General Terms.
NZXT warrants that any part of the hardware system, excluding software, documentation, and similar items (the “System”) will be free from defects in workmanship and materials for a period of two years after the date of delivery of the System, or such longer period as applicable under the terms of any extended warranty option purchased by you (the “Warranty Period”). During the Warranty Period, NZXT will repair, replace, or refund, as determined by NZXT in its sole discretion, any defective Systems or parts thereof. This Warranty does not cover and, for the purposes of this Warranty, “System” does not include, software applications or programs, including without limitation, any operating systems and third-party software, or any documentation that was included with the System. NZXT’s obligations under this Warranty, at its sole discretion, to repair, replace, or refund for a System that manifests a defect in materials or workmanship ceases upon the expiration of the Warranty Period.
NZXT will never charge you for labor or phone support for repairs covered by this Warranty.
If you are not satisfied with the System for any reason, you may contact NZXT within 14 days from the date of delivery and NZXT will refund you for the price you paid to NZXT for the System, provided, however, that NZXT will not refund any fees for custom work to the System (if applicable), software, assembly, or shipping and handling. If you want to cancel an order after the order was placed and the System has not been built yet, NZXT will offer a full refund (including shipping and assembly fee) for your order. If the System is built and is ready to be shipped, NZXT will not refund the assembly fee from the order ($99 for regular service, $199 for Blitz service).
For Canada shipping fees, NZXT does not cover importation fees nor is it liable for such fees. NZXT takes reasonable precautions to ensure that all of our Systems leave our facility without any scratches or dents. This Warranty only covers cosmetic damage larger than a U.S. dime if reported to NZXT within twenty-one days after the date of delivery of the System to you.
This Warranty does not cover damage or defects that are due to normal wear and tear, accident, abuse, misuse, problems with electrical power, usage that is not in accordance with the System instructions, failure to follow the System instructions, or failure to perform preventive maintenance. Your Warranty will be rendered void if the service tag or serial number is missing, damaged, or altered. If you upgrade or change the System in any way after it is delivered to you, this Warranty shall immediately become void.
Frames Per Second Guarantee.
For all Systems for which NZXT has provided a frames per second (“fps”) guarantee (the “Guarantee”), NZXT warrants that the fps for such System will be within 10% of the Guarantee. If your System does not meet the level of any applicable Guarantee, NZXT will repair or replace your System at NZXT’s option.
All FPS Estimates are provided by Underwriters Laboratories (UL Solutions). More information on UL Solution benchmarks can be found here.
All Guarantees are based upon stock configurations for the System’s CPU and GPU combination running under normal system conditions. Any modifications to your System that are not authorized in advance by NZXT in writing, including without limitation overclocking or underclocking the GPU and/or CPU, will void the Guarantee with respect to that System. In addition, the Guarantee will not apply to the extent that NZXT reasonably determines your System is operating at less than optimum conditions (e.g., running a video capture program simultaneously with a game), or where NZXT reasonably believes performance data indicating a failure to comply with the Guarantee has been obtained via hacking, doctoring, or through other fraudulent means.
Disclaimers & Limitation of Liability.
Some states do not allow the following exclusions or limitations, so these exclusions and limitations may be limited in their application to you.
Repair or replacement as outlined herein constitutes your sole and exclusive remedies for breach of this Warranty. NZXT shall not be liable for any direct, indirect, special, incidental, consequential or other damages, whether based upon breach of contract, breach of warranty, negligence, or strict liability, including but not limited to loss of profit, loss of revenue, loss of data or software, loss of use of the System, loss of use of related equipment, cost of substitute or replacement equipment, “down-time”, your time, injury to property, and all claims of any third parties. EXCEPT AS EXPRESSLY STATED HEREIN, NZXT MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO PRODUCTS SOLD BY NZXT, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR A PARTICULAR PURPOSE.
YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE DATA STORED ON YOUR SYSTEM AS A PRECAUTION AGAINST POSSIBLE FAILURES, ALTERATION, OR LOSS OF THE DATA. BEFORE RETURNING ANY SYSTEM, BE SURE TO BACK UP DATA AND REMOVE ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION. TO THE EXTENT PERMITTED BY LOCAL LAW, NZXT IS NOT RESPONSIBLE FOR DAMAGE TO OR LOSS OF ANY PROGRAMS, DATA, OR REMOVABLE STORAGE MEDIA. TO THE EXTENT PERMITTED BY LOCAL LAW, NZXT IS NOT RESPONSIBLE FOR THE RESTORATION OR REINSTALLATION OF ANY PROGRAMS OR DATA OTHER THAN SOFTWARE INSTALLED BY NZXT WHEN THE SYSTEM IS MANUFACTURED, SUBJECT TO ANY APPLICABLE UPDATES. MEMORY DATA MAY BE LOST DURING REPAIR.
Your Responsibilities.
In order for NZXT to provide you with the best possible service under this Warranty, you agree to:
- Provide true, accurate, and complete information when filing a claim.
- Provide an environment that meets NZXT requirements, including protecting the System from corrosion, contamination, and spills.
- Cooperate with NZXT in attempting to resolve any issues using online chat, email, or telephone. This may involve performing routine diagnostic procedures, installing additional software updates or patches, removing third-party options, and/or substituting options.
- Verify configurations, load most recent firmware, install software patches, and run diagnostics and utilities on your System.
- Make periodic backup copies of your files, data, or programs stored on your hard drive or other storage devices as a precaution against possible failures, alteration, or loss. Before returning any System for warranty support or repairs, you agree to back up your files, data, and programs, and remove any confidential, proprietary, or personal information.
- Remove any external options or accessories that would be subject to loss during the repair or replacement process.
Entire Agreement.
This Warranty, including the Terms of Service, the Packing Instructions, any End User License Agreements or other terms applicable to specific NZXT products or services, contain the entire understanding between you and NZXT, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and NZXT with respect to the System.
